Conflicting Interpretation Of Agreement Causes Delays In Implementation

South Sudan parties Disagree on Responsibility Sharing in three States and local Government
Juba 22nd August, 2020. South Sudan parties under the formed committee by the presidency on responsibility sharing at state and local government levels disagreed on allocation of responsibilities in three states cabinet and they disagreed on number of counties to be subjected to responsibility sharing.

On the issue of the counties, the government is proposing only 76 counties to be subject for responsibility sharing because the government takes a position that the formed administrative units should not be subject for responsibility sharing. While the SPLM-IO and SSOA totally rejected the Government position and they demanded that the 79 counties plus the two administrative units should be subject to responsibility sharing per their recent signed resolution on the size of the state and local governments in Juba dated 10th August, 2020 .

Community Empowerment for Progress Organization is urging the South Sudan parties to continue with the positive spirit of compromising for genuine implementation of the R-ARCSS demonstrated in the past among them. The underling factor for the disagreement among the parties is issue of interpretation of the provisions of the Revitalized Agreement on the Resolution of the Conflict in South Sudan (R-ARCSS) on responsibility sharing. This factor is becoming a real issue for hindering timely and genuine implementation of the R-ARCSS.

Mr. Edmund Yakani, Executive Director of CEPO, said the issue of lack of consensus in interpreting the provisions of R-ARCSS is becoming a real obstacle for timely implementation of R-ARCSS. It is clear that, IGAD should intervene by assigned experienced political and legal expert for helping the parties with proper interpretation of the R-ARCSS provisions in terms of meaning and the spirit behind the provision. The parties clash over matters of R-ARCSS provisions interpretations can easily aid the culture of lack of political will for genuine implementation of R-ARCSS.

This means a lot in the terms of delivering the proposed institutional and policy reforms agreed in the peace agreement including facilitation of genuine population census, constitutional making and elections processes. Finally, CEPO is kindly urging the South Sudan parties to embrace the political culture of making compromise and giving chance for actual meaning of the peace provision to prevail. CEPO is urging IGAD to assign expert for interpretation of R-ARCSS provision when the parties clashed over R-ARCSS provisions interpretation
