Condemnation of the SPLM Youth League Election

SUBJECT: CONDEMNATION OF THE SPLM YOUTH LEAGUE ELECTION

The SPLM youth have been waiting for the time when the SPLM youth representatives from Boma, Payam, County and the STATES to the National Level will come so that they elect who they think can lead them as stipulated in the SPLM Basic Rule. This process however has been highly waited for, to take place in the respective areas by those who want to participate in the SPLM affairs but in vain. Few days ago after the SPLM Chapters International Conference ended, we learnt that Akol Paul and Martin Majut have invited youth from all the ten STATES to attend a training workshop. The delegates were tend by Akol Paul and Martin Majut and use them to carry out the SPLM Youth League election on July 28, 2007 at the Nile Resort Camp. Election went on and Akol Paul won.

We condemn this election and call those behind it to cancel it and follow the right procedures which are in conformity with the SPLM Basic Rules and Regulations, because of the followings reasons:

The representatives were not chosen based on the SPLM rules of representation where ones must be send from Boma to Payam to County to State and then to the National level. They were just hand picked by Martin Majut in conjunction with SPLM State Secretaries who hold SPLM positions and don’t practice SPLM basic rules and regulations. The last time Akol went to his constituent in Rumbek was in early 2006, all this time he was in Nairobi. How did he by pass all the procedures that one follows to reach the SPLM National Level without going home where they are done. The answer is that, the Lakes State SPLM Secretary just appointed him in Nairobi direct to Juba. Is that not a violation of SPLM Basic Rules and Regulations?

The electoral committee composes of Martin Majut, organizers and Akol Paul himself. Akol, apart from being a candidate, was the one setting out the election rules. Where on earth has it ever happened that a candidate contesting for the seat is also the one chairing or even participating in electoral committee. Akol was threatening the delegates to crawl back to their respective States if they don’t vote for him and he promised not to provide the air ticket for those who will not vote for him.

Many high profile SPLM members and leaders who organized this election use their public positions to intimidate voters to vote for Akol. They had restricted the number of contestants for the chairmanship so that Akol win without any pressure from his opponents. The organizers had also refused to give other candidate a chance to campaign before the election so that he can sell his policy to the voters. What the body, that was responsible for this election did is a clear violation of the SPLM INTERIM BASIC RULES AND REGULATIONS; ARTICLE EIGHT- Number one. Which state that “A member of the organization has the right to elect and be elected to any of the various offices and structures of the organization”. This act by those who organized this election, has also led to the violation of ARTICLE 22- 4(g). i.e.
4- The following conduct by a member shall constitute misconduct in respect of which disciplinary proceedings may be invoked and instituted against him or her. g) - “Behaving in such a way as to provoke serious divisions or a break down of unity in the Organization”. The intimidation of the delegates not to exercise their rights to vote for who they want by the electoral organizers, has caused division to the extend that some SPLM members expresses pulling out of the Party or abandon anything related to SPLM if it has become a property of few individuals who has got certain political power in the government.

Even if the election were free and fair, it has still violated the ARTICLE 11 OF THE SPLM BASIC RULES AND REGULATIONS. According to this article, we first have to elect the Interim States and National Councils before electing the Youth League Chairman.

Apart from the Yei NATIONAL INTERIM POLITICAL BUREAU meeting which set up all the SPLM Secretariats, no any member of the secretariat was mandated to impose or organize the youth in a way that is not in conformity with SPLM Basic Rules and Regulations. So Martin Majut who was trust with task of organizing the youth for the National Convention where they will elect their National Youth leaders, fail us on July 28, 2007 when he hand pick the delegates and brought them for the election, instead of getting the delegates through the methodology stipulated in the SPLM Basic Rules and Regulations. That is from BOMA to PAYAM to COUNTY to STATE and then to the NATIONAL Level.

Akol Paul Kordit, before he can be elected again to other public office, he must account for all New Sudan Youth Association (NSYA) assets. So apart from the irregularities in this election, Akol is not fit to lead the SPLM youth again due to his past corrupt practices in NSYA where he was running the institution which people put him in against very people that chooses him there. Very few among us can be bribe by Akol Paul to forget the Methodist Guest House in Nairobi incident where Akol uses foreign police forces to dispatch an assembly that has called their leader to either deliver the Constitution or leave the office for those who are fit to deliver us our Constitution. Another incident I believe you can not forget is the meeting at Railway Club were the general assembly called former NSYA finance secretary Mr. John Biar Atem and Akol Paul to brief the assembly on what went wrong with NSYA finances that has brought a great misunderstanding between Akol and Biar. Biar came and Akol refuses to come. Since then, Akol has never initiated to call the assembly and account for all NSYA assets. Many attempts by youth to call him have either been dispersed by police or he refuses to come.

It may be a common practice to ridge in most of the elections held. But the call for democracy must always prevail. It should be brought into the attention of the SPLM Leadership as a ruling party that this culture of democratic governance must be practice effectively in the activities of the Party without fear or favor. It should be noted that the SPLM Secretary for Popular and Syndicated Organizations had sided with the former alleged chairman of NYSA for the scandal to intimidate the innocent participants in the workshop and forcefully carried out unfair elections in which the Electoral Organizers emerged unanimously with Mr. Akol Paul as a candidate. Furthermore, the electoral Organizers designed some elections rules that favored him as mentioned below;

Election was done through the raise of hands which many participants disputed and opt for the secret ballot but the organizers refused. The SPLM Constitution clearly put it that, all the elections must be through the secret ballot.

As usual in many elections, when people are voting, the candidates they are voting for has to go out and they should not be in the voting hall. But for this case, Akol Paul was allowed to still stay in as people vote for him.

We the under signed members ask the SPLM Leadership to cancel the election and tell the STATES Secretaries or form a committee with a mandate of one month to bring new representatives elected using the methodology stipulated in the SPLM Constitution and Basic Rules and Regulations, because it was done in serious violation to the SPLM Basics Rules and Regulations. If you don’t encourage corruption, then you better allow Akol Paul or persuade him since you are the one harboring him, to account for what he did in New Sudan Youth Association (NSYA). Akol Paul as we all knows during his leadership in NSYA, he using his relationship to the SPLM leadership to undermind other SPLM members who are not of his standard. He has no respect for the leaders and elders of the party. We are not opposing the election Akol Paul as youth league chairman, if he was elected in a manner compatible with the SPLM Laws, we would respect his leadership and wait until the next election comes. But the manner in which he steal our leadership need to be reverse if we stand by the rules we signed as a party. Before we take any action that may discourage the Party Harmony, we beg you to treat this matter with seriousness it deserves. We will not stop our operations to reverse this election but your action will help us reach a peaceful solution.

Youths’ responses against petition dated 29th July 2007 of the election of SPLM youths league

The recent petition made by some myopic, selfish handful of youths in Juba against the election of Akol Paul as the Chairman of SPLM youth league is baseless and unfounded. We the youths are absolutely condemning any petition against this election. It was fairly and satisfactorily conducted in that representatives were drawn from all the 10 states of Southern Sudan based on SPLM rules and regulations. However, the claim that Akol and Martin did not draw representatives from Bomas, Payams, Counties and States levels is not true. They have taken representatives from states where by Bomas, Payams, and Counties fall under the states if our brothers have to use their five senses.

We the youths hereby acknowledged the outcome of the results simply because the representatives represent all the 10 states and we are the ones who delegated them to elect a right leader on our behalves. This explains that elections were justly and fairly conducted in respect to basic rules of SPLM which actually organizers of that election did. If you are excluded among the delegates, does that define the elections were not free and fair? Please, we want to assure you that, your exclusion does not necessarily mean elections were not fair. All what you are doing is contrary to what we youths are doing. You don’t have to write rubbish stuffs against some one with potentials and credibility. We are hereby again referring you to have a little pondering of yourself. Take a mile back to your academic backgrounds and records and then come and tell us what you want.

Our brothers also talked of SPLM states secretaries of not being efficient and fit in their work, we want to let you know that these are the right people the SPLM has chosen to carry out the SPLM ideologies. Therefore, we don’t see a reason as to why you framed it that they are not fit and don’t know their duties. The selection of the representatives was done by SPLM secretaries right from Boma, Payam, County to State which is in accordance to SPLM rules. Furthermore, you have also said that Akol was appointed while in Nairobi without going through the levels you claimed he should have followed, we want you to answer our query; “when the elections were conducted, were there no representatives from your Bomas?” The answer is absolutely that there were representatives from your Bomas,payams,counties and states appointed at the same criteria and mechanism that Akol went through.

We would like to caution our brothers and sisters that it is not high time we should expose our ignorance towards our leaders rather, it is time for us to cooperate and work hand in hand, though you consider them as incompetence. Let us work for the betterment of our Party (SPLM) and ensure success.

Last but not least, we want to take this opportunity to thank our comrades who organize the elections, delegates from various states who voted wisely and decisively to elect some one with credibility. We are satisfied by the way you have elected our SPLM youths Chairman, whom every one has been longing for. We also thank the SPLM leadership for having recognized the roles of the Youths in reconstruction of Southern Sudan by incorporating them in the SPLM leadership.

WE MAINTIN THAT THE ELECTION OF AKOL WAS RIGGED


The author of the document should first read between his/her lines before going to talk about ignorance and all those sort of rubbish, the letter it’s self is portraying ignorance that they are talking about if you like it.

We will continue to be firm that the election of Akol was rigged whatever justification you want to write will never change what we have witness, a point for you to note the next time you may desire to write a letter like that for public consumption should sound with some manners, remember the position of youth chairmanship is a political position and it’s subject to nullification, don’t think you own SPLM.

educated persons like you will never write a letter like you have written, we have we weight how much you have in terms of education that you’re talking about, please recall your letter and apologies to the people you call your brothers and Sisters.

Tell us, who selects people form the Bomas, counties and state level respectively? Obviously the answer is Akol. Think twice comrades
